Build Heaven ("we," "us") is owned and operated by Mason Tyson. These terms apply to this website and to the website design, redesign, and management services we provide. By using this site or hiring us, you agree to them.
What we do
We design, build, and maintain websites for local businesses. The exact pages, features, and deliverables for your project are described in the quote or proposal we send you. That quote, once you accept it, together with these terms, forms our agreement.
Quotes, demos, and pricing
A website demo is free and comes with no obligation. Prices depend on the size and functionality of the site and are set out in your quote. A quote is valid for 30 days unless stated otherwise. Work begins after you accept the quote and pay the deposit, if one is listed.
Payment
- Build fee. A one-time fee to design and build your website, invoiced as set out in your quote.
- Monthly plan. Hosting, maintenance, and updates are billed monthly in advance. The amount and what it includes are listed in your quote.
- How you pay. Payments are processed through Square. You can pay by bank transfer (ACH) or card; bank transfer is preferred, but cards are accepted. Square's own terms apply to the payment itself.
- Automatic payments. If you choose to pay your monthly plan automatically, you authorize us to charge your saved card or bank account through Square each month for the plan amount in your quote, until you cancel as described below. We will tell you in advance before your monthly price changes.
- Taxes. Prices do not include sales tax. If tax applies to a service, it will be shown on your invoice.
- Late payment. Invoices are due on the date shown. If an invoice remains unpaid for 15 days after its due date, we may pause work or suspend hosting until it is paid. We will contact you before we do.
Ownership
You own your domain name and your content, including text, photos, logos, and anything else you provide, from the start, and you give us permission to use that content to build and run your website. Once the build fee is paid in full, the completed website is yours. We keep ownership of any general tools, code libraries, or techniques we use across projects, and we may reuse them.
Your responsibilities
- Provide the content, photos, and information we need, and review drafts within a reasonable time. Delays here will move the launch date.
- Make sure you have the right to use everything you give us, including photos, logos, and text. You are responsible for content you supply, and you agree to cover any claim arising from it.
- Make sure the claims on your site are accurate and that your business holds any licenses it advertises.
We may decline to publish, or may remove, content that is illegal, infringes someone else's rights, or is misleading.
Timelines
We estimate launch timelines in good faith, typically one to two weeks for a standard site. Timelines depend on how quickly content and feedback arrive and are estimates, not guarantees.
Changes after approval
Changes requested after you approve the design, such as added pages or new features, may change the price and timeline, and we will tell you before doing the work.
Hosting and maintenance
Websites on a monthly plan are hosted through third-party providers. We aim for continuous availability but do not guarantee uninterrupted service, since outages, provider issues, and scheduled maintenance can occur. Maintenance covers the updates described in your quote and does not include a redesign or major new functionality.
Accessibility
We build sites using common accessibility practices, such as readable text, descriptions for images, and keyboard-friendly navigation. Unless your quote says otherwise, we do not guarantee that your site meets any specific accessibility standard or law.
Third-party services
Your website and our billing may rely on services we do not control, such as hosting, domain registration, email, form delivery, maps, booking tools, or payment processing through Square. Those services have their own terms, and we are not responsible for their performance or changes they make.
No guarantee of results
A professional website helps customers find you, trust you, and contact you. We do not promise a specific number of visitors, leads, customers, sales, or search engine rankings, since those depend on factors outside our control.
Portfolio
We may show your website, its screenshots, and your business name as an example of our work, unless you ask us in writing not to.
Cancellation
You may cancel a monthly plan at any time by emailing us with 30 days' notice. Fees already paid are not refundable, your plan continues through the end of the paid period, and automatic payments stop after that.
When your plan ends, you keep your domain, your content, and your website. We will send you the site files or help move the site to a new host. Help beyond a reasonable handover may be billed at our standard rate. If the site has not been moved by the end of the paid period, we may take it offline, and we will keep a copy for at least 30 days in case you need it.
If you cancel a build in progress, you are responsible for the work completed up to that point, and we will invoice accordingly.
We may end a monthly plan with 30 days' notice. We may also suspend or end it sooner if an invoice remains unpaid as described above, or if the site is used for anything illegal or harmful.
Warranties and liability
We provide our services with reasonable skill and care. Beyond that, the site and services are provided "as is," without other warranties, express or implied. To the extent the law allows, our total liability for any claim relating to our services is limited to the amount you paid us in the three months before the claim, and we are not liable for lost profits, lost business, or indirect or consequential damages.
Resolving problems
If something goes wrong, please contact us first. We both agree to try in good faith to resolve any dispute informally for at least 30 days before taking legal action.
Governing law
These terms are governed by the laws of the State of Texas, and any dispute will be handled in the state or federal courts located in Travis County, Texas.
Use of this website
The text, design, and graphics on this website belong to Build Heaven. Please do not copy them for your own use without permission. Website concepts shown on this site are examples of our design work and are labeled as concepts.
General
These terms and your accepted quote are our entire agreement about your project. If they conflict, your quote controls. If any part of these terms cannot be enforced, the rest still applies. If we do not enforce a term right away, we have not given up the right to enforce it later. Notices, including cancellations, may be sent by email.
Changes to these terms
We may update these terms and will post the new version here with a new date. For active monthly plans, we will email you at least 30 days before a change that affects you takes effect. Changes do not affect a project already underway unless we both agree in writing.
